ADU Builder in San Marcos, CA

San Marcos writes its own ADU code, and three parts of it catch Carlsbad readers off guard: smaller caps on backyard units, water and sewer charges set by Vallecitos Water District, and Very High fire zoning across most of the San Elijo Hills ridge.

Short answer

Inside San Marcos city limits, a single-family lot can take a JADU, an attached ADU and a detached ADU, each approved by building permit under Chapter 20.410 of the zoning code with no hearing. A detached unit is held to 16 ft, sits in the back half of the lot at least 4 ft from the side and rear lines, and is capped by the City's FAQ at 850 sq ft on lots under an acre. The city is inland, so no coastal permit ever applies. Its pre-approved PRADU plans get a decision within 30 days. A licensed San Diego County general contractor takes San Marcos requests through this site; the rules here are San Marcos's, not Carlsbad's.

Size, height and setbacks in San Marcos

Ordinance 2024-1551 last rewrote Chapter 20.410 on September 24, 2024. The JADU and attached limits are clear; the detached cap is where the City's own documents disagree.

The code text and builder guides describe the detached cap by bedrooms instead (850 sq ft for one bedroom, 1,000 sq ft for two or more), and state law does not let a city cap a unit with more than one bedroom below 1,000 sq ft. Ask Planning which reading it applies before paying for plans.

On hillside lots, parts of the City's Ridgeline Overlay, Chapter 20.260, also apply to ADUs where state law allows. Whatever the local limits say, state law still protects one new detached unit of up to 800 sq ft and 16 ft, 4 ft off the side and rear lines.

A converted garage keeps its existing walls with no new setbacks and may grow by up to 150 sq ft, only for a way in and out. The garage conversion guide covers the slab, insulation and egress work.

San Marcos fees, line by line

  • Plan check and permit. The March 3, 2025 schedule lists flat "City Standard" ADU fees of $1,166.08 for plan check and $2,584.24 for the permit at every size up to 1,000 sq ft, about $3,750 together. A custom design is priced on valuation: from $250,001 to $500,000 the permit alone is $4,636.56 plus $12.98 per added $1,000, with plan check on top.
  • Public Facilities Fee. None under 750 sq ft, says the City FAQ, and a size-based share above that. San Marcos lets owners defer it until utility release with a recorded lien. We did not find the current rate, so ask the Building Division.
  • School fee. San Marcos Unified's rate became $5.38 per sq ft on June 9, 2026, owed above 500 sq ft of assessable area, and a garage conversion counts. Take the City's "School Fees Letter" to 255 Pico Avenue, Suite 250; the district takes checks or cash only.
  • Water. Vallecitos's 2025 schedule (effective January 2, revised June 3) puts the total base fee for a 3/4 in. meter at $16,976, including $6,542 for the San Diego County Water Authority. That is about three times Carlsbad's meter cost. Most conversions inside existing space cannot be made to take a separate connection, so many owners stay on one meter.
  • Sewer. The District's January 2024 wastewater schedule charges $16,506 for a full single-family EDU. A new ADU can only be charged in proportion to its size or plumbing fixtures, and the posted schedules show no ADU category, so get Vallecitos's figure in writing.
  • CFD annexation. San Marcos pays for police, fire, lighting and landscaping through Community Facilities Districts 98-01 and 98-02, and some parcels are mapped for annexation when developed. One local builder reports that new ADUs of 750 sq ft or more face an annexation ballot the City Council certifies four times a year, adding three to four months and often $1,000 to $2,000 a year in special tax. The City has not confirmed this for ADUs, so ask its CFD administrator.

The code also requires a water and sewer "will serve" letter before the building permit. Vallecitos serves most of the city, but the City also names Vista Irrigation District and Buena Sanitation District, and County Environmental Health for septic lots.

HOAs and master-planned communities

Much of San Marcos was built as planned communities, so an association often reviews plans first. The largest is San Elijo Hills, about 1,921 acres in the southern hills, approved by the City Council in 1997 and built by the San Elijo Hills Development Company, with its own homeowners association and Double Peak Park. Venzano and Old Creek Ranch sit nearby.

Civil Code 4751 voids association rules that block a single-family ADU or make one unreasonably costly, though sensible design rules still stand, and the City's FAQ warns that conflicting CC&Rs can expose an HOA to damages. San Marcos also requires the unit to match the house on roofing, fascia, siding, colors, doors and windows, which tends to satisfy an architectural committee too. The HOA approval guide covers board submittals and written denials. Lake San Marcos has its own community association, but its permits come from the County, so the figures on this page do not carry over.

Fire hazard zones on the hills

The State's 2025 Fire Hazard Severity Zone maps raised hillside San Marcos sharply. A local outlet reported San Elijo Hills going from about 80% to about 99% Very High, and that High and Very High homes now need a fire-hardening inspection at sale. We did not confirm zones for Twin Oaks Valley or other edges; the City's wildfire page links the CAL FIRE viewers for each address.

  • The Fire Department's checklist for new houses in a Very High zone calls for Chapter 7A and R337 construction and 150 ft of fuel modification on all sides, drawn on the plans. Ask the Fire Marshal how much of that applies to your ADU.
  • In a High zone the checklist adds 20 ft of brush clearance from the fronting road.
  • Sprinklers go in the ADU only if the house requires them, with no retrofit of the house.

Permits and timeline

  1. Confirm city or County

Check that the parcel is inside city limits and get its zone; Planning answers at planningdivision@san-marcos.net.

  2. Pick PRADU or custom

The PRADU program began January 1, 2025 under Government Code 65852.27. You add a site plan, stormwater forms and deferred truss and solar submittals, but the City's plan set cannot be altered. Custom plans need a licensed design professional.

  3. Line up utilities and the CFD

Request the Vallecitos will-serve letter early and ask whether a CFD ballot is needed before the application counts as complete.

  4. Apply online

Since early January 2025 the City takes permit applications only through its online system, with a free account. Only the owner or a licensed California contractor can pull the permit.

  5. Review

Planning, Building, Land Development Engineering and Fire Prevention all review. The 60-day decision clock pauses while you answer corrections; PRADU sets get 30 days. Builders report five to seven months to permit in practice, and no soils report unless grading is proposed.

  6. Build and final

The ADU cannot get its certificate of occupancy before the main house, which matters only when both are new.

Costs and rental math in San Marcos

Build costs in San Marcos run in similar North County ranges to the ADU cost calculator, which is calibrated for Carlsbad. There a 500 sq ft detached unit is about $260,000 all-in at mid finish, 750 sq ft about $330,000, a 400 sq ft garage conversion $145,000 to $153,000, and a 550 sq ft attached unit about $213,000. Swap its meter and sewer lines for the Vallecitos numbers above and add any CFD cost.

HUD FMR FY2026, San Diego metro$2,288$2,459$3,001

Asking-rent averages, mostly apartments. Zumper's studio figure rose 48% in a year, a sign of a thin sample.

San Marcos one-bedrooms rent a little under the calculator's Carlsbad band. Cal State San Marcos had more than 16,000 students in fall 2023, and Palomar College adds more, which helps small units on leases. Nightly rentals are out; every ADU or JADU lease must run 30 days or more.

A rough case: a 400 sq ft garage conversion let as a studio at $2,400 grosses $28,800 a year. Less 5% vacancy and 5% upkeep ($1,440 each) and about $660 of added property tax, about $25,260 is left before insurance and the Vallecitos sewer bill. On roughly $149,000 that pays back in about six years, longer where Mello-Roos or a CFD tax applies.

San Marcos ADU questions

I live in Lake San Marcos. Does the City's ADU code apply?

No. Lake San Marcos is an unincorporated community, even though the city surrounds it, so County Planning & Development Services issues the permit and sets the limits. Vallecitos still supplies the water.

Can a two-bedroom detached ADU be 1,000 sq ft on a normal San Marcos lot?

Possibly, but get it in writing. The City's FAQ caps detached units at 850 sq ft below an acre, while the code text and state law point to 1,000 sq ft once a unit has two bedrooms. One email to Planning with your lot size and floor plan settles it before design fees pile up.

If I convert my garage, do I have to replace the parking?

No replacement garage or carport is needed, but existing driveway spaces must stay. A new unit otherwise needs one paved space unless it is within a half mile of public transit, such as the SPRINTER stops at Palomar College, San Marcos Civic Center and Cal State San Marcos.

Will Vallecitos make me buy a separate water meter?

Not for most conversions inside existing space. For a new detached unit it may, and a 3/4 in. meter's total base fee is $16,976 on the 2025 schedule, so ask the District before you settle the layout.
