Granny Flat and Casita Questions in Carlsbad

Whether you call it a granny flat, a casita, a backyard cottage or an in-law unit, the City of Carlsbad treats it as an accessory dwelling unit. These are the questions Carlsbad owners ask once they get serious, answered from City bulletins, the municipal code and state law.

Short answer

A casita or granny flat in Carlsbad is an ADU in the eyes of the City, and most single-family lots can have one plus a JADU. You can rent an ADU without living on site, as long as each lease runs over 30 days, and it stays tied to the main house when you sell. Only the new unit is added to your property tax bill. City impact fees start at 750 sq ft and school fees above 500 sq ft. Inside the Coastal Zone, a detached casita needs a minor coastal permit as well as a building permit.

Rules: what you can build

Is a casita or granny flat the same thing as an ADU in Carlsbad?

Yes. "Casita," "granny flat," "in-law unit" and "backyard cottage" are everyday names. The Carlsbad Municipal Code uses two terms: an accessory dwelling unit (ADU), which can be detached, attached or converted from existing space, and a junior accessory dwelling unit (JADU), which is 500 sq ft or less inside the house or an attached garage. Both need a separate entrance and a permanent kitchen. A guest room without a kitchen isn't an ADU. The attached ADU and JADU page explains how the two smaller types differ.

How many units can I add to a single-family lot?

Per IB-111, the City allows one attached or detached ADU plus one JADU on a single-family lot. State law also requires a combination of one converted ADU, one detached ADU and one JADU. Multifamily and duplex lots follow different counts, and inside the Coastal Zone the cap on detached ADUs for those lots is two.

How big can a granny flat be?

Freestanding units top out at 1,200 sq ft, and past 800 sq ft lot coverage also counts. An attached ADU is limited to half the house's floor area or 1,200 sq ft, whichever is less, though 800 sq ft is always allowed. A conversion can't exceed the size of the main house, plus up to 150 sq ft for an entry. Carlsbad has no minimum lot size and no bedroom-count limits. Details for backyard units are on the detached ADU page.

Is a two-story granny flat allowed in Carlsbad?

Attached to the house, yes: up to two stories, at 25 ft or the zone's limit. A unit above or below a detached garage can reach the zone's height limit, two stories including the garage. A standalone detached ADU is held to 16 ft, or 18 ft (plus up to 2 ft for a matching roof pitch) within a half-mile walk of Carlsbad Village or Poinsettia station. A February 2026 ordinance (CS-506) reportedly dropped the one-story rule for detached units, according to The Coast News. The City's October 2025 bulletin and the official code text still show it, and the change may not apply in the Coastal Zone until the Coastal Commission certifies it. Confirm with the City's Planning Division before designing a second floor.

Do I have to add a parking space for the ADU?

One space is the default, and it can sit in a setback or in tandem on your driveway. Many lots need none: within a half-mile walk of public transit, within a block of car share, in a historic district, or when the ADU is built inside existing space. JADUs never need parking. Converting a garage usually doesn't require replacing its spaces, except near the coast: everything west of the railroad, plus the band between the railroad and the freeway that runs from Avenida Encinas south to Batiquitos Lagoon. The garage conversion page covers those areas.

Does the owner have to live on site?

For an ADU, no. Carlsbad's 2024 Ordinance CS-474 removed the City's option to require owner occupancy. A JADU is different: the City's deed restriction requires the owner to live in the JADU or the main house. Starting in 2026, state law narrowed this to junior units without their own bathroom. How the City now applies it is worth confirming with Planning.

Cost, fees and taxes

How much does a casita cost in Carlsbad?

In our calculator, a 500 sq ft detached casita comes to about $260k at mid-grade finishes, and a 750 sq ft unit about $330k, both all-in with design, fees and contingency. A 300 sq ft JADU starts near $70k. Slope, long utility trenches and a separate electric meter are added on top. The cost page breaks each line out.

Will a granny flat raise my property taxes?

Only for the new unit. Under Prop 13 an ADU counts as new construction, and the County Assessor gives just that new portion its own base-year value when it is finished. Your house keeps its existing assessed value. SnapADU reports San Diego assessor values of about $130 to $165 per sq ft for new ADUs, often below what they cost to build. A 2024 bill (SB 1164) that would have excluded ADUs for 10 years failed, so no exclusion applies.

When does the school fee apply?

Only above 500 sq ft. Carlsbad Unified's rate is $5.38 per sq ft (approved April 15, 2026), and San Marcos Unified charges the same rate. Once a unit crosses 500 sq ft, the City's worked example charges the whole floor area, so an 800 sq ft unit pays about $4,304. Four districts serve parts of Carlsbad, so check which one covers your address.

When do City impact fees kick in?

At 750 sq ft. ADUs smaller than that pay no impact fees, and above it the fees scale with the ADU's size compared with the house. In Carlsbad the main one is the Public Facilities Fee. JADUs at or under 500 sq ft are exempt too. Holding a design to 749 sq ft is a common way to avoid the fee. Regular permit and plan check fees, which the City says run about $2,000 to $4,000 for most ADUs, apply at any size.

Renting it out

Can I rent my ADU on Airbnb?

Not as a short-term rental. Carlsbad's recorded Notice of Restriction says no rentals under 30 days, and state law requires ADU and JADU rentals to exceed 30 days. The City's rule doesn't reach units permitted before 2020. Leases longer than 30 days, furnished or not, are allowed.

Can I sell the ADU separately from my house?

No. AB 1033 lets cities opt in to separate ADU sales as condominiums, and Carlsbad hasn't adopted that ordinance, per the City's October 2025 bulletin. The only exception is the narrow nonprofit path in state law. A JADU can never be sold separately.

What rent could a Carlsbad granny flat bring in?

Using fall 2026 Zillow and Zumper data, we plan on roughly $2,000–$2,600 a month for a studio, $2,300–$3,000 for a one-bedroom and $2,900–$3,800 for a two-bedroom. The calculator subtracts vacancy, added property tax, the extra sewer charge and upkeep to show a net figure and a simple payback.

HOAs, coastal and fire zones

Can my HOA stop me from building a casita?

Not outright if you live in a single-family planned development. Civil Code 4751 strikes down association rules that amount to a ban on ADUs and JADUs, while leaving room for reasonable design review. In April 2026 a San Diego judge sided with Mystic Point, a Carlsbad condo HOA, against an owner's garage-to-unit conversion, finding the law didn't cover condos. A 2026 bill, AB 956, has been reported as signed; if so, from January 1, 2027 the protection covers condos and other common interest developments too. Read the Carlsbad HOA guide before you apply.

How do I know if my lot is in the Coastal Zone, and what changes?

The City's coastal zone page has a map and an address lookup. Roughly, the zone covers the area west of El Camino Real, about 37% of the city. Inside the line, backyard units and garage conversions take a minor Coastal Development Permit, decided by City staff with neighbor notice but no hearing. Converted uncovered parking spaces must be replaced. Builders report the coastal permit roughly doubles the time to reach a building permit.

Does the 2025 fire hazard map affect my ADU?

It can. In High and Very High zones, new buildings need ignition-resistant Chapter 7A construction, and in Very High zones 100 ft of defensible space. Moderate zones have no added requirements. The City's wildfire page has an address search that compares the 2007 and 2025 maps. Fire sprinklers in the ADU are required only if the main house needed them.

The process

How long does the City take to approve a granny flat?

State law gives the City 60 days to approve or deny once your application is complete, and review is ministerial, with no public hearing. Total time to a permit, including design, runs longer: builders report about three to four months outside the Coastal Zone and six to eight inside it. The design-build process page walks through each stage.

Does Carlsbad have free pre-approved casita plans?

Yes, through the ADU Permit Ready Program: four single-story detached plans from studio to three bedrooms, in three styles. The City says they save three to six months and $8,000 to $16,000 in design fees, and they get expedited review. In 2023 the City had received just one building permit application using them, so few builders have worked with them yet. San Diego County's pre-approved plans can't be used inside Carlsbad city limits.
