Carlsbad ADU Requirements and Permits: The Complete Guide
Carlsbad keeps its ADU rules in one section of the zoning code, then layers the Coastal Zone, the 2025 fire maps and state law on top. Here is all of it on one page, each rule linked to its source.
Permit drawingsShort answer
Carlsbad approves ADUs ministerially under CMC 21.10.030: no public hearing and a 60-day state deadline once the application is complete. A detached ADU can be up to 1,200 sq ft and 16 ft tall (18 ft, up to 20 ft with a matching roof pitch, within a half mile of Carlsbad Village or Poinsettia station), 4 ft from side and rear lot lines. An attached ADU is capped at 50% of the house or 1,200 sq ft, whichever is less, with 800 sq ft always allowed. A JADU is up to 500 sq ft inside the house. Rentals must run more than 30 days, the ADU cannot be sold separately, and in the Coastal Zone, about 37% of the city, detached ADUs and conversions also need a minor Coastal Development Permit.
1. The ordinance behind the rules
The rules live in Carlsbad Municipal Code 21.10.030, in the R-1 zone chapter. Its history on ecode360, the City's official code host, lists three ordinances:
- Ord. CS-427 (2022)
- Ord. CS-449, adopted June 6, 2023
- Ord. CS-474, adopted August 20, 2024, which among other things deleted the City's old option to require owner occupancy of an ADU
A newer amendment, Ord. CS-506, was reported adopted on second reading on February 3, 2026, taking effect 30 days later, to bring the code in line with SB 477, SB 1211 and AB 2533. We have seen it only in The Coast News and a third-party code mirror, which notes it is pending Coastal Commission certification inside the Coastal Zone. Where it changes something below, we flag it; confirm with the Planning Division.
Review is ministerial, with no hearing, and ADUs do not count toward density. Where state ADU law conflicts with the Local Coastal Program, the LCP wins (IB-111). Definitions are in CMC 21.04.121 and 21.04.122, setbacks in 21.45.090 Table F, coastal permits in 21.201. The City's summary is Information Bulletin IB-111, revised October 2025.
2. Size, height and setbacks
| Rule | Detached ADU | Attached ADU | Conversion ADU | JADU |
|---|---|---|---|---|
| Maximum size | 1,200 sq ft, subject to lot coverage | 50% of the house or 1,200 sq ft, whichever is less; 800 sq ft always allowed | Up to the size of the main home, plus up to 150 sq ft for entry and exit | 500 sq ft |
| Height | 16 ft; 18 ft (20 ft with matching roof pitch) within ½ mile walk of a major transit stop; 18 ft on a lot with a multistory duplex or multifamily building | 25 ft or the zone limit, two stories max | Existing structure | Inside the house |
| Side and rear setback | 4 ft | 4 ft | Existing setbacks kept (Coastal Zone rules aside) | None new |
| Front setback | Per zoning, but it cannot block an ADU of at least 800 sq ft | Existing | None new | |
| Lot coverage | Applies over 800 sq ft | Applies over 800 sq ft and over 16 ft tall | n/a | n/a |
Sources: CMC 21.10.030.E; IB-111 (Oct 2025); CS-449 Table F. There is no minimum lot size and no bedroom-count tier. Size is measured as interior livable space under state law.
Details that catch people out
- The two transit stops. Carlsbad Village Station and Poinsettia Station qualify for the taller height.
- One story or two. The ecode360 text and IB-111 still cap detached ADUs at one story. The Coast News reports CS-506 removed that cap. Until the City publishes the new text, and inside the Coastal Zone until the Coastal Commission certifies it, design to one story or get the answer from Planning in writing.
- Over a detached garage. An ADU above or below a detached garage follows the zone height limit, two stories maximum counting the garage.
- No roof decks on detached ADUs; the mirrored CS-506 text extends that to attached units.
- Coastal separation. The August 2024 IB-111 required 10 ft between the main home and a Coastal Zone detached ADU over 800 sq ft. We did not find that line repeated in the October 2025 version, so ask.
Design and building requirements
- Roofing, trim, walls, windows and colors match the main home
- New detached ADUs include solar PV
- Separate entrance and a permanent kitchen
- Fire sprinklers only if the main home was required to have them
- A geotechnical report on lots near slopes or bluffs, regardless of size
3. How many units you can add
Single-family lots
IB-111 allows one attached or detached ADU plus one JADU. State law also guarantees a fixed combination: one ADU converted from existing space, one new detached ADU and one JADU. On a lot with room for all three, that means three units behind the main house. AB 956, a 2026 state bill reported signed for January 1, 2027, would raise the guaranteed number of new detached ADUs on a single-family lot to two; see the HOA guide for what else it changes, and treat it as reported until you see the chaptered text.
Duplex and multifamily lots (SB 1211)
- Conversions of existing non-livable space: up to 25% of the existing units, minimum one.
- Detached ADUs outside the Coastal Zone: up to eight on a lot with an existing duplex or multifamily building, but not more than the number of existing units, per HCD. Two if the building is only proposed.
- Detached ADUs inside the Coastal Zone: up to two.
Counts are from IB-111 and the HCD handbook; confirm the Coastal Zone figure with Planning.
4. Parking, including the replacement-parking area
An ADU needs one parking space, which can sit in a setback or tandem on the existing driveway. None is required if any of these is true:
- The lot is within a half-mile walk of public transit
- It is in a historic district
- The ADU is part of an existing or proposed home or accessory structure
- A car-share vehicle is within one block
- On-street parking permits are required but not offered to the ADU occupant
JADUs need no parking. When a garage or carport is converted or torn down for an ADU, the lost spaces normally do not have to be replaced. Carlsbad keeps one exception, the Parking Replacement Areas added by CS-474:
- everything west of the rail corridor, and
- the strip east of the rail corridor and west of I-5, between Avenida Encinas and Batiquitos Lagoon.
In those areas, plan for replacement spaces when you convert a garage. Separately, anywhere in the Coastal Zone, converted uncovered spaces must be replaced. Village, Barrio and beach-area owners should read the garage conversion guide first.
5. Who can live there, rentals and sale
| Question | ADU | JADU |
|---|---|---|
| Must the owner live on site? | No. CS-474 removed the City's option to require it. | Carlsbad's code and deed restriction say yes: the owner lives in the JADU or the main home (or one of the three units if there is also an ADU). Since January 1, 2026, state law requires it only when the JADU shares a bathroom with the house. |
| Short-term rental? | No rentals of 30 days or less. The rule is recorded in a Notice of Restriction (CMC 21.10.030.E.11). Units permitted before January 1, 2020 are exempt. | |
| Sell it separately? | No. Carlsbad has not adopted the AB 1033 opt-in ordinance (Gov. Code 66342). Only the narrow nonprofit and qualified-buyer path in Gov. Code 66340–66341 remains. | Never |
State law probably controls where the two JADU rules conflict, but Carlsbad has not said how it applies it now. Get Planning's answer in writing before recording the deed restriction.

6. The Coastal Zone
About 37% of Carlsbad, 14.4 square miles with 7 miles of coastline, is in the Coastal Zone, roughly the part of the city west of El Camino Real. Inside it, the City's Local Coastal Program governs, and some ADUs need a coastal permit on top of the building permit. The City approved a comprehensive LCP Land Use Plan update in October 2021 and sent it to the Coastal Commission that December; the City still describes it as pending.
Which ADUs need a coastal permit
| ADU type | Coastal permit |
|---|---|
| Detached ADU | Minor Coastal Development Permit (Form P-6) |
| Conversion of a garage or other structure | Minor Coastal Development Permit (Form P-6) |
| Attached ADU | Generally building permit only, as an exempt improvement to an existing home (CMC 21.201.060(A)(2)) |
| JADU | Generally building permit only, same exemption |
The exemption for attached ADUs and JADUs falls away if the home is nonconforming as to habitat buffers or geologic setbacks, or the site is on a beach or wetland or within 50 ft of a bluff edge. The 2024 bulletin also limited it to sites outside the Coastal Appeal Zone. For example, CDP 2026-0011 was a minor CDP for a 796 sq ft attached ADU on a vacant lot.
How a minor CDP is decided
- The City Planner decides it at staff level. The code says no discretionary approval is required for ADUs (21.201.080(C)(1)(a)(ii)).
- Neighbors receive notice, but no one can request an administrative hearing on an ADU (21.201.080(B)(1)).
- There is no local appeal (21.201.120(A)). The approval can be appealed to the California Coastal Commission.
- State law (Gov. Code 66329) gives a city with a certified LCP 60 days to act on an ADU coastal permit, with no public hearing.
The appeal zone, where a Coastal Commission appeal is possible, covers land between the sea and the first public road, within 300 ft of a beach or the mean high tide line, within 300 ft of a bluff face, and within 100 ft of a wetland or stream (21.201.130(A)). Builders report Coastal Zone ADUs taking 6–8 months to permit, against 3–4 months elsewhere.
How to check your address
- Open the City's Coastal Zone and development permits page.
- Use the address lookup or the PDF Coastal Zone map posted there.
- If your lot is near the boundary, cross-check the Coastal Commission's statewide Coastal Zone map (June 2025).
- Email Planning@carlsbadca.gov with the parcel number if the maps leave any doubt. Ask too whether the lot is in the appeal zone.
7. Fire hazard severity zones
The State Fire Marshal released updated Fire Hazard Severity Zone maps for Carlsbad's local responsibility area in March 2025, the first update since the City adopted maps in 2007. The City Council adopted them on June 17, 2025, effective 30 days later. The 2007 maps showed only Very High zones; the 2025 maps add Moderate and High.
| Zone | New construction | Defensible space | At sale |
|---|---|---|---|
| Very High | Chapter 7A ignition-resistant construction | 100 ft for new buildings | Natural hazard disclosure |
| High | Chapter 7A ignition-resistant construction | "Do not currently apply" | Natural hazard disclosure |
| Moderate | No requirements | ||
Source: City of Carlsbad Wildfire Risk Mitigation Program. Sale inspections under Civil Code 1102.19 carry a $180 City fee.
A detached ADU in a High or Very High zone is a new building, so it is designed to Chapter 7A from the start: ignition-resistant siding, vents, eaves, windows and roofing. Fire sprinklers are a separate question, required in the ADU only if the main home had to have them. The Council introduced the 2025 Fire Code and the state Wildland-Urban Interface Code in November 2025; we have not confirmed final adoption. We found no Carlsbad rule that bars ADUs in a fire zone.
To check your lot, use the address search on the City's wildfire risk mitigation page, which has a slider comparing the 2007 and 2025 maps. The City does not publish zone lists by neighborhood, so search the exact address. Questions go to wildfiremitigation@carlsbadca.gov.
8. The City's permit-ready ADU plans
Carlsbad's ADU Permit Ready Program, funded by an HCD grant under Housing Element Program 1.2, offers free pre-approved plans for single-story detached ADUs: four floor plans (studio, one, two and three bedrooms, roughly 400 to 1,000 sq ft) in three styles, Farmhouse, Spanish and Contemporary. The City estimates they save three to six months of design time and about $8,000–$16,000 in design fees. Unmodified plans qualify for expedited processing and lower plan check fees; changing a plan sends it back to full review. The City's 2023 housing report counted one application using them that year.
San Diego County's pre-approved plans cover unincorporated land only, not Carlsbad.
9. Submitting the application
Confirm the lot's overlays
Check the Coastal Zone, appeal zone, fire zone and Parking Replacement Areas before design; each changes the drawings.
Prepare the drawings and reports
Site plan, floor plans, elevations, structural, Title 24, solar on a new detached unit, and a soils report where needed.
File the coastal permit if needed
For a detached ADU or conversion in the Coastal Zone, the minor CDP (Form P-6) runs with the building application.
Apply for the building permit
Every ADU needs a residential building permit on Form B-1. The permit-ready checklist (B-75) also lists forms P-20, B-59 and E-34, the grant deed and a title report from the last six months.
Plan check and corrections
The City has 15 business days to say whether the application is complete and 60 days from a complete application to approve or deny, unless you ask for a delay. A denial must include written fixes. The application stays valid for one year from submittal while corrections are routed and resubmitted.
Pay fees and record the restriction
Pay City fees and the school fee, then record the notarized ADU Notice of Restrictions before the permit issues.
The City's online Customer Self Service portal currently handles only permits that generally skip plan review, such as re-roofs, pools and solar, so ADU plan check does not go through it.
10. How long it takes
The legal clock is 60 days from a complete application, but design, corrections and fee payment sit outside it. SnapADU reports about 3–4 months to permit outside the Coastal Zone and 6–8 months inside it. The City publishes no plan check turnaround times. For a full schedule from first visit to move-in, see how the design-build process runs.
11. Fees in brief
The City puts permits for most ADUs at about $2,000–$4,000 by size. Impact fees start at 750 sq ft and are proportional to the ADU's size relative to the house; the school fee starts above 500 sq ft at $5.38 per sq ft in Carlsbad Unified; conversions within existing space pay no utility connection fees. Building permit fees are based on construction valuation or unit cost, and Form B-40 gives an estimate. The City's worked example, line by line, is on the ADU cost page.
12. State law behind Carlsbad's code
Most numbers above are state floors. Key sections, as renumbered in 2024:
- Gov. Code 66314: ADU standards, including the sprinkler rule
- Gov. Code 66317 and 66335: completeness within 15 business days and action within 60 days
- Gov. Code 66321: size and height floors
- Gov. Code 66322: parking exemptions
- Gov. Code 66323: the guaranteed unit combinations and multifamily counts
- Gov. Code 66329: coastal permits within 60 days with a certified LCP
- Gov. Code 66333: JADUs, including the 2026 owner-occupancy change
- Gov. Code 66311.5: impact and connection fees
- Civil Code 4751: HOAs cannot prohibit ADUs or JADUs
HCD's ADU Handbook, updated March 2026 with the changes in effect January 1, 2026, explains each one in plain terms.

Carlsbad ADU permit questions
How big can an ADU be in Carlsbad?
Detached: 1,200 sq ft. Attached: half the floor area of the house or 1,200 sq ft, whichever is smaller, but never less than 800 sq ft. JADU: 500 sq ft inside the existing home. A garage or other conversion can match the main home's size plus 150 sq ft for access.
Can I build a two-story ADU in Carlsbad?
An attached ADU can have two stories within 25 ft or the zone limit, and an ADU over a detached garage can have two stories counting the garage. For a freestanding detached ADU, the published code and IB-111 still say one story; CS-506 reportedly removed that cap in 2026. Ask Planning which text applies to your lot.
Do I need a Coastal Development Permit for my ADU?
In the Coastal Zone, yes for a detached ADU or a conversion: a minor CDP decided by City staff with no hearing. Attached ADUs and JADUs are usually exempt unless the lot is near a bluff, beach or wetland or the home is nonconforming for habitat or geologic setbacks.
Do I have to live on the property?
Not for an ADU. For a JADU, Carlsbad's code still requires the owner to live on site, while state law since 2026 requires it only if the JADU shares a bathroom with the house. Confirm the City's current position before recording the deed restriction.
How long does Carlsbad take to approve an ADU permit?
The City must decide within 60 days of a complete application. Counting design and corrections, builders report about 3–4 months to a permit outside the Coastal Zone and 6–8 months inside it. More general questions are answered on the Carlsbad ADU FAQ.
