Encinitas sits right below Carlsbad on the map, but it runs its own ADU ordinance, its own coastal permit process and its own fee rules. A licensed San Diego County general contractor takes Encinitas ADU, JADU and garage conversion requests through this site, and this page covers the rules that apply south of La Costa Avenue.
You can add one ADU and one JADU to a single-family lot in Encinitas, and the City waives its own plan review and inspection fees for them. The bigger hurdle is coastal: the Coastal Commission puts about 14 square miles, roughly 71% of the city, inside the Coastal Zone, and there a coastal development permit is needed for any unit that is detached, adds habitable floor area or converts a garage. Plan review runs about 15 working days per cycle by the City's estimate. Budget for school fees on units over 500 sq ft, a geotechnical letter on new buildings over 500 sq ft, and a large water capacity charge if you want the ADU on its own meter.

Summarized from PLN-118. Front setbacks follow the zone. Confirm height for your zone with Planning.
Encinitas R-3 and R-5 zones carry 10 ft side setbacks and R-8 runs 5 and 10 ft, so the 4 ft ADU setback frees up real yard. The trade is height: a detached unit at 4 ft stays at 16 ft. A two-story detached ADU generally has to meet full zone setbacks and the limit of two stories or 22 ft that covers most residential zones. On R-3 to R-25 lots averaging over 10% slope, the 12 ft and 16 ft limits are measured from the uphill side or road crown.
You cannot convert a garage and also build an ADU above it. Layouts on the detached ADU page carry over, but its heights are Carlsbad's.

The Permit Ready ADU program
The City launched its free Permit Ready ADU (PRADU) plans in 2019: eight sets from two local architects, each offering a studio, one-, two- and three-bedroom. Design Path Studio's run 350, 555, 745 and 938 sq ft per the City. The Coast News reported DZN Partners' range as 224 to 1,199 sq ft.
In 2019 the City estimated $8,000 to $14,000 saved on design plus $2,000 to $4,000 in waived fees, and three to six months cut from planning. You still pay for a site plan, soils testing, utilities and school fees, plus a deferred solar permit. Any change to a plan ends its pre-approved status.
The program is still listed by the City, and since January 1, 2025 private designers can get plans pre-approved too. We could not confirm the 2019 sets were refiled for the current building code, so ask Planning first.
Coastal permits in Encinitas
Under section 30.48.040.T.21, a coastal permit is needed when a unit is not fully inside the house, adds habitable area, or converts non-habitable space. That pulls in detached units, garage conversions and even a JADU with a small bump-out.
File online
The building permit goes into the Customer Self Service portal, and the planner opens a separate coastal review.
Notice
A sign goes up, and the City mails notice to owners and occupants within 500 ft, with 10 days for comments.
Decision
The Director signs a Notice of Decision. In the Coastal Commission appeal area, 10 business days for appeals follow.
Paperwork
The owner signs a notarized indemnification and records a covenant barring separate sale and short-term rental.
Timing varies. A 502.5 sq ft Leucadia garage conversion was noticed April 23, 2026 and approved May 5. A 285 sq ft Cardiff JADU was noticed in August 2025 and approved in May 2026. Both decisions required a soils report with the building plans.
In the Coastal Bluff Overlay, nothing new goes within 40 ft of the bluff top, and an ADU addition is capped at 10% of the home or 250 sq ft, whichever is greater. Inland, an ADU must stay off natural slopes of 25% or more.
Community by community
Each of the five communities lands on a different mix of zoning, utilities and coastal rules. The City's MyEncinitas Map shows which water and sewer agencies serve your parcel.
Leucadia
Water comes from San Dieguito Water District and most sewer from Leucadia Wastewater District. West of Coast Highway 101, between Swami's and La Costa Avenue, parking removed for a garage conversion must be replaced on the lot. Bluffs line much of this shoreline, so check the bluff overlay on west-side lots.
Old Encinitas
Downtown and the Encinitas Coaster station put many lots within a half mile of transit, so the parking space is waived. Sewer is mostly the City's Encinitas Sanitary Division; water is San Dieguito. The west-of-101 replacement rule covers coastal blocks north of Swami's.
Cardiff-by-the-Sea
Sewer is the City's Cardiff Sanitary Division and water is San Dieguito. The 2026 JADU approval there sat on an R-8 lot with a Special Study Overlay. On tight lots an interior unit often fits best; the attached ADU and JADU page covers layouts, but here any added floor area means a coastal permit.
New Encinitas
Water is split between San Dieguito and Olivenhain MWD, and Leucadia Wastewater handles most sewer. Check CC&Rs for design review; state law still stops an HOA from effectively blocking a single-family ADU.
Olivenhain
Olivenhain is the rural, equestrian side of the city, with winding streets, a dark-sky policy and minimum lots of a half acre to five acres, so a 1,200 sq ft detached unit is often realistic. Zone height in its RR to RR-2 zones is 26 ft. The Coast News reports CalFire rates Olivenhain a Very High Fire Hazard Severity Zone, which brings ignition-resistant construction. Water is Olivenhain MWD. Lots not on sewer may need County health approval.
What an Encinitas ADU costs
The ADU cost calculator is set for Carlsbad, but Encinitas construction falls in similar North County ranges. Mid-finish planning figures on a standard site: 750 sq ft detached about $330,000 ($284,000 to $376,000), 1,200 sq ft detached about $456,000, 400 sq ft garage conversion $145,000 to $153,000, 550 sq ft attached about $213,000, 300 sq ft JADU about $100,000.
Where Encinitas fees differ:
City fees: the calculator's $2,000 to $4,000 permit line mostly drops out. Keep a small allowance for state fees, postage and recording.
School fees: only over 500 sq ft. The state Level 1 cap rose to $5.38 per sq ft in January 2026, shared between the elementary district (Encinitas Union for most addresses) and San Dieguito Union High. Confirm the split with both.
Separate water meter: San Dieguito lists $21,427 for a new 3/4 inch service (short side) or $24,527 (long side) from March 1, 2026. Olivenhain MWD runs $20,495 to $33,679 by zone. Many projects keep the house's meter; ask whether it needs upsizing.
Sewer: hookup fees scale with size and fixtures. A 2013 City manual listed $2,680 per unit in the Encinitas division and $3,417 in Cardiff; get current numbers.
Reports: a geotechnical letter above 500 sq ft, and a boundary certification within 5 ft of a line.
State law bars impact fees on ADUs of 750 sq ft or less. Above that, ask how the City's July 2026 park and facility fees apply.
Permits and timeline
Applications go in only through the Customer Self Service portal, with a grant deed, square footage calculations, stormwater form and Title 24 report. A new detached ADU must be all-electric, solar may be required, and sprinklers apply only if the house has them. Inspections booked by 3 p.m. happen the next business day.
Plan on design, one or more 15-day review cycles, coastal notice on most lots, then construction. The design-build process page shows the stages; the coastal step here is Encinitas's own.
Rental math
Zumper's October 2026 Encinitas averages: studio $2,750, one-bedroom $2,800, two-bedroom $4,500. Zillow's: $2,100, $3,250 and $4,500. HUD's FY2026 San Diego metro Fair Market Rents: $2,288, $2,459 and $3,001. For a backyard unit, plan on roughly $2,100 to $2,750, $2,450 to $3,250 and $3,000 to $4,000.
Example: a 600 sq ft one-bedroom at $2,800 grosses $33,600 a year. Less 5% vacancy, 5% upkeep and about $1,000 of added property tax, roughly $29,250 remains before sewer and insurance, near 10% a year on a $288,000 build before financing.

Encinitas ADU questions
Do I need a coastal permit for a JADU in Encinitas?
Only if the JADU adds floor area or converts space that was not habitable. A JADU carved out of existing bedrooms inside the house does not trigger it, but a JADU with even a small addition does, as the 2026 Cardiff approval shows.
Is the whole city in the Coastal Zone?
No. The Coastal Commission's 2026 staff report puts about 71% of Encinitas in the zone. Check your parcel on the City's map rather than guessing from distance to the beach.
Can I rent my Encinitas ADU on Airbnb?
No. City code bars running an ADU as a short-term rental, and the covenant you record before the permit requires rentals of 30 days or more. A JADU covenant also requires the owner to live on the property.
Are the free Encinitas permit-ready plans worth using?
They can be if one fits your lot as drawn. Any change sends the plans to full review. Ask Planning whether the set you want reflects the current building code before you commit.
I have an old unpermitted unit. Can Encinitas refuse to legalize it?
For a unit built before January 1, 2020, the City cannot deny the permit unless a correction is needed for a substandard condition. Coastal rules still apply, and converting non-habitable space still needs a coastal permit.
Last checked November 7, 2026. Encinitas rules are summarized from City documents; fees, coastal status and fire zones are set parcel by parcel, so confirm with the City's Planning Division before you design.
